How the credit is computed
AssemblyAI Platform publishes its credit — it is simply not a band table, so there is no tier here for a measured uptime percentage to land in. It accrues with the length of the outage instead of stepping at an availability threshold.
The vendor’s own published rate is 1% of the monthly invoice for the applicable Order Form, for each non-prorated hour of downtime in the calendar month below the 99.9% Service Level Guarantee, and Service Credits are expressly non-refundable; a Customer must be in compliance with all obligations under the SLA, the Agreement and the applicable Order Form to be eligible. Capped at a maximum of ten (10) Service Credits in a given calendar month, i.e. up to 10% of the monthly invoice; Service Credits are not refundable and may only be applied against outstanding Fees owed to AssemblyAI.

THE COMMITMENT (§1): "AssemblyAI will use commercially reasonable efforts to make the Platform available to Customer for 99.9% of all Scheduled Availability Time in a given calendar month, calculated on a monthly basis (the 'Service Level Guarantee')." THE WINDOW: Customer must expressly request Service Credits WITHIN TEN (10) DAYS FOLLOWING THE END OF THE CALENDAR MONTH in which the failure occurred — anchored to month-end, DEADLINE_BASIS.assemblyai = end_of_billing_month, the Buildkite/Confluent/Influxdata shape. Missing it forfeits the credit. ELIGIBILITY: Customer must be in compliance with ALL of its obligations under this SLA, the Agreement and the applicable Order Form; non-compliance disqualifies the claim. §2 ties the credit to a numerical miss — the Cloudflare Workers precedent — so the "commercially reasonable efforts" wrapper in §1 does NOT demote the figure to a target; the credit is denominated in cash % of the invoice but the Service Credit is AssemblyAI's SOLE AND EXCLUSIVE REMEDY for any failure to meet the Service Level Guarantee. - ⏰ TEN DAYS FROM THE END OF THE CALENDAR MONTH, NOT FROM THE INCIDENT — the SLA says it in those exact words: §2 "Customer must expressly request Service Credits within ten (10) days following the end of the calendar month in which the failure occurred in order to receive them." That is the shortest post-month window in this catalog after Buildkite's five business days — put the date in the calendar the moment the month closes, because missing it forfeits the credit outright.
- ⚠️ CONFIRM YOU ARE IN COMPLIANCE WITH ALL OF YOUR OBLIGATIONS before filing — §2 conditions eligibility on being "in compliance with all of its obligations under this SLA, the Agreement and the applicable Order Form". Non-compliance disqualifies the claim however bad the month, so clear any outstanding invoices and acceptable-use issues before the request goes out.

- COMPUTE THE CREDIT THEIR WAY, PER HOUR AND NOT PER TIER: §2 pays 1% of your monthly invoice for the applicable Order Form "for each non-prorated hour that AssemblyAI does not provide the Platform in accordance with the Service Level Guarantee". Count only WHOLE hours below the 99.9% Service Level Guarantee for that calendar month — part-hours do not count — and total them before quoting a percentage.
- APPLY THE CAP: credits cap at TEN (10) Service Credits in a given calendar month (i.e. up to 10% of that month's invoice). Even a catastrophic month pays 10%, not 100%.
- ⚠️ THE CREDIT IS NOT CASH AND IS NOT REFUNDABLE: §2 says Service Credits "may be applied against outstanding Fees owed to AssemblyAI by Customer, but such Service Credits are not refundable to Customer". Do not ask for a refund; ask for the credit to be applied against your next invoice. If you have no outstanding Fees, there is nothing for the credit to attach to.
